Appealing an Enforcement Notice

You have the right of appeal to the Secretary of State against Enforcement Notices served by the Council.  However, there is no right of appeal against either a Breach of Condition Notice or a Stop Notice.

Appeals must be sent to the Planning Inspectorate acting on behalf of the Secretary of State within the strict time limit specified in the notice. The appeal must be delivered, or posted in time to be received in the ordinary course of post, by the Secretary of State before the date specified for the enforcement notice to take effect. It is important that the enforcement appeal form is completed accurately, including the full grounds of appeal, or that this information is included in a letter, and is accompanied by all the relevant documents. Late appeals cannot be accepted.

Completed appeal forms can be returned by post or can be completed on-line via the Planning Portal web site and sent electronically.  Appellants should also send a copy of the completed enforcement appeal form and relevant documents direct to the local planning authority.
