The Mental Capacity Act 2005

What is Mental Capacity?

Mental Capacity refers to the ability to make decisions for yourself about your own life. Some people have difficulties in making such decisions. This is called ‘lacking capacity’.

How will it affect you?

The Mental Capacity Act covers all sorts of major decisions where a person may lack the capacity to decide for themselves, about things like financial, social care, medical treatment and research arrangements, as well as everyday decisions.

It will also affect their families, carers, health and social care staff, and other people who may have contact with them. The Act will generally affect people aged 16 and over.

What is happening in Hackney?

To facilitate the Mental Capacity Act (MCA) implementation in Hackney, a project board has been established.

Also an Independent Mental Capacity Advocate (IMCA) has been set up for people who lack capacity, or the help of family or friends to express their views. Contact them to find out more at -
