Planning Contributions Supplementary Planning Document
The Planning Contributions SPD was adopted on 1 November 2006 following a period of consultation earlier in the year. All comments received during the consultation were much appreciated and have been used to inform the final document.
Planning contributions, also known as section 106 agreements, are legally binding agreements typically negotiated between local authorities and developers in the context of planning applications. Used properly, planning contributions enhance the quality of both the development and the wider environment, to help ensure that the development makes a positive contribution to sustainable development. For example if a new housing scheme was being developed, the Section 106 agreement could state that a new play area be provided and the developer would fund this. Section 106 agreements can bring more than environmental improvements and can provide funding for things like training or other skills development, improving public transport as well as securing Affordable Housing.
The Supplementary Planning Document (SPD) for Planning Contributions (s106) forms part of the emerging Local Development Framework. The SPD sets out the Council’s approach to determining planning contributions when considering planning applications for development in Hackney. The objective of the SPD is to provide clarity to developers, development control officers, stakeholders and local residents regarding the basis on which planning contributions will be sought. The SPD details the type of planning contributions that may be required, the qualifying development thresholds and monetary contribution formulae where appropriate and indicates the relative importance that the Council places on the varying types of planning contribution.

Sustainability Appraisal
As required by planning legislation, an assessment of how the SPD will impact on the substantiality of the Borough has been undertaken through the concurrent development of a sustainability appraisal. The Sustainability Appraisal consists of sustainability objectives, targets and measurable indicators.
