Notice of proposal to make a Dog Fouling Control Order within the London Borough of Hackney

The Council proposes to make a Dog Fouling Control Order under section 55 of the Clean Neighbourhoods and Environment Act 2005. The Dog Fouling Control Orders (Prescribed Offences and Penalties, etc) Regulations 2006 makes it an offence for failing to remove dog faeces.

We hereby invite representations on our proposal to make a Dog Fouling Control Order.

Order Proposal

Fouling of land by dogs

The proposal is to designate all land within the control of the London Borough of Hackney and to which the public have access, as a dog control area. For the purposes of the Order land which is open to the air on at least one side is to be treated as land which is open to the air.

Land to be included within the control area will be all: -

  • parks and recreational areas
  • cemeteries owned by the London Borough of Hackney
  • Council owned allotments
  • public roads in the Borough and the footpaths, cycle paths and verges adjacent to these roads.
  • school playing fields and school play grounds and other land within the curtilage of school and colleges
  • Council owned housing estates (Hackney Homes estates)

It will be an offence for any person in charge of a dog which defecates on any designated land not to remove the faeces. This offence will not apply to disabled people in charge of guide dogs for the blind or other support dogs unless their disability is such that it does not prevent them from being aware of and removing faeces

Penalty

Anyone who commits an offence under the provisions of Order will be liable on conviction in the Magistrates Court to a fine of up to £1,000.

The Council also intends to issue £80 Fixed Penalty Notices and anyone who fails to pay a Fixed Penalty Notice may be prosecuted.
