Which applications require a Design and Access Statement?

A Design and Access Statement will be required for ALL planning applications except for:

•A material change in the use of land or buildings, unless it also involves operational development;

• Engineering or mining operations; and

• Development of an existing dwelling house, or development within the curtilage of a dwelling house for any purpose incidental to the enjoyment of the dwelling house, where no part of that dwelling house or curtilage is within a designated area.  "Designated area" includes all conservation areas and sites of special scientific interest (SSSI’s).

Important Note: This means that all householder applications affecting a dwelling within a Conservation Area in Hackney will require a Design and Access Statement.

ALL Applications for Listed Building Consent require a Design and Access Statement.  Design and Access Statements are not required for applications relating to advertisement control, tree preservation orders or storage of hazardous substances.

What happens to my application if I do not submit a Design and Access Statement in the prescribed format?

The application will not be registered and validated and therefore cannot be considered by the Council.

At what stage will I have to submit a Design and Access Statement with my planning application or application for listed building consent?

At the same time as the application forms, fees and plans are submitted to the Council.
